This contract concerning guided tours and related services includes the following conditions:


1. Scope of Validity

The following General Terms and Conditions are valid if thus agreed between both parties to the contract.

2. If the tour guide acts as a travel guide (especially transfers), working time shall count as a guided tour (§ 126 Abs 4 GewO).

3. The contractor is requested to issue two separate bills to their clients, one covering the fee for the tour guide (Führungshonorar) and one for the booking and administration fee.

4. Cancellation

Cancellation shall not be subject to a cancellation fee if the tour is cancelled in writing 5 days (date of receipt) prior to the agreed date of the tour. If the tour is cancelled 5 to 3 days before the date of the tour, the contractor shall be subject to a cancellation fee of 50 % of the agreed fee. If the tour is cancelled less than 3 days before the agreed date, the whole amount of the agreed fee shall be paid. 3 days include the agreed date of the tour and the day of the cancellation. The client shall also pay the full amount of the agreed fee if they do not arrive at the agreed meeting point in the agreed waiting time. Cancellation fees are standardised and are not related to fault or loss of profit. They have to be paid for every single cancelled tour.

5. Waiting time

Should the client not arrive on time, the tour guide shall wait at the agreed meeting point for an hour. Waiting time will be deducted from the duration of the tour and will therefore decrease its length.

6. Should the tour guide be delayed, the client shall wait for 15 minutes. This waiting time has no effect on the length of the tour. If the tour guide is absolutely prevented from coming, he or she is committed to send a substitute with the same level of professional training and to inform the client of the change beforehand.

7. Payment

Payment shall be effected in cash and without deductions directly after the tour or after receipt of the bill. For payment in cheque an administration fee of up to 13 Euro can be charged. Preparation of a tour program is charged separately. In the event of default in payment, interest of 1 % per month (12 % per year) will be added to all overdue balances.

8. The tour guide may not propose to the guests brought to them by the contractor to contact the tour guide directly in the future. Provided there is no agreement to the contrary and no planned program by the tour operator or the travel guide, the tour guide is allowed, however, to propose additional services to the guests following the planned tour.

9. It is forbidden to make audio or video recordings of the guided tour.

10. Tour guides do not take on third party liability. Participation in the tour is at one’s own risk.
